Plaintiff, 37, was struck from behind with minimal property damage. Plaintiff claimed he aggravated both his hips that were surgically corrected by Core Decompression surgeries within two years of the accident for avascular necrosis. Defendant claimed the minimal impact did not cause the injuries claimed and that Plaintiff’s condition required surgery in the near future regardless of whether he was involved in an accident or not. Plaintiff had both his hip replaced after the accident. Plaintiff received damages for having had both surgeries much earlier than expected (2-5 years), leaving him potentially open to having an additional surgery down the road. Health Insurance limited the medical balances/liens owed and the claim was resolved prior to trial for $325,000.00.
