Plaintiff, 38 was struck while working by a forklift while walking to his car at a pier (while leaving work). Plaintiff received $80,000 in compensation from his Worker’s Compensation carrier. A lawsuit was filed against the employer of the forklift operator for failing to keep a proper lookout. Defendant alleged Plaintiff was negligent for not keeping a proper lookout and not wearing his PPE vest when struck. Plaintiff sustained a lacerated ear and required physical therapy, an L5-S1 disc repair with interbody fusion and some subsequent pain management. Settled $760,000
